These Terms of Service ("Terms") are an agreement between you and Beyond Play Inc ("Beyond Play", "we", "our", "us"). By creating an account or using the BeyondPlay app or websites (the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old to use BeyondPlay. If you are between 13 and the age of majority where you live, you may use the Service only with the consent of a parent or guardian who agrees to these Terms on your behalf. We may suspend or terminate accounts that misrepresent age.
You sign in with a supported identity provider and are responsible for activity on your account. Keep your device and sign-in method secure, and tell us promptly at support@beyondplay.xyz if you suspect unauthorized use. Access to the Service may require an invite during early access. You can delete your account at any time in the app (Settings → Privacy → Delete Account).
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service. You may not copy, modify, reverse engineer, scrape, or resell the Service or access it by automated means except as permitted by us in writing.
"User Content" is anything you create or submit on the Service — games, prompts, chat messages, comments, profile information, and images. You keep ownership of your User Content. You grant Beyond Play a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, publish, publicly display, and distribute your User Content for the purposes of operating, promoting, and improving the Service — for example, showing your published games in the feed and on leaderboards. This license ends when your User Content is deleted from the Service, except for content that persists in anonymized form as described in the Privacy Policy, and for copies other users lawfully made while it was public (for example, remixes you allowed).
You are responsible for your User Content. You represent that you have the rights to what you post and that it does not violate anyone else's rights or any law.
Create Studio builds games with the help of third-party AI models (named in the Privacy Policy). You understand that: (a) your prompts and attached content are processed by those AI providers; (b) AI output may be inaccurate, imperfect, or similar to output generated for other users, and is provided "as is"; (c) games you publish — including AI-assisted ones — are your User Content and your responsibility; and (d) you may not use Create Studio to generate content that violates Section 7, and we may filter, refuse, or remove AI-generated content that does.
You agree not to create, publish, or share content that:
You also agree not to cheat in challenges or manipulate scores or leaderboards, not to circumvent moderation, rate limits, or access controls, and not to use the Service to develop a competing dataset or model.
You can report games, users, or messages in the app and block users you don't want to hear from. We may review, filter, hide, or remove any content, restrict features, and suspend or terminate accounts that violate these Terms — with or without notice, at our sole discretion. We may preserve and share information with law enforcement where required. If you believe content was removed in error, contact support@beyondplay.xyz.
Score duels and leaderboards are for fun; they involve no wagering, no entry fees, and no prizes of monetary value. Results are determined by the Service and may be corrected or voided where we detect cheating or technical error.
The Service depends on third-party services (sign-in providers, AI providers, cloud infrastructure). Their availability is not guaranteed by us, and their terms govern your use of them where applicable.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT USER OR AI-GENERATED CONTENT WILL BE ACCURATE OR APPROPRIATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEYOND PLAY INC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT FULLY APPLY TO YOU.
You will indemnify and hold Beyond Play Inc harmless from claims arising out of your User Content, your use of the Service, or your violation of these Terms or of anyone else's rights.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections 5–8 and 11–15 survive termination.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction, except where the law of your country of residence grants you mandatory protections or venue.
We may update these Terms as the Service evolves. We will post the new version here and update the "Last updated" date; for material changes we will notify you in the app. Continuing to use the Service after changes take effect means you accept them.
